If the health care bill is expected to pass through the Senate by the end of this month, medical malpractice tort reformers will have a very narrow window in which to add a damages cap to the $848 billion bill drafted by Majority Leader Harry Reid. Opponents of tort reform point out that a damages cap would ultimately take advantage of people who have been most injured by malpractice.

According to the senators, the $250,000 proposed cap on pain and suffering awards is arbitrary and low.
