<p>A settlement conference has been set up to come to an agreement over the case. The suit is filed by a relative of the woman and he is claiming that the treatment of her bed sores led to her death.</p>
<p>The man alleges that the staff allowed the woman to develop pressure sores and then did not monitor them appropriately. The man is seeking $50,000 costs for violating the Nursing Home Care Act, wrongful death and violating the Family Expense Act.</p>

			<content:encoded><![CDATA[<p>Wisconsin&#8217;s Senate passed a major medical malpractice bill this January that allows parents to recover for the loss of an adult child due to alleged medical malpractice.</p>
<p>The bill has now advanced to the Assembly for a vote. If successful in being passed, the bill can also apply to the reverse, i.e. an adult child may also receive compensation for the loss of a parent due to medical malpractice.</p>
<p>At the moment, these suits are impossible. This means that if a widow or widower without a minor child dies due to medical malpractice, nobody can bring a claim for it.</p>
<p>Originally, the bill was sponsored by the Senate Judiciary Committee in September, 2009. An additional reform proposal is expected to be voted on in the Senate soon, which would remove the current 180-day deadline for potential medical malpractice suits against state-run facilities and extend that period to a three year statute of limitations. This would make the period in which claims could be filed against state-run institutions consistent with the period allowed after injury to file a claim against private facilities.</p>

However, when she complained of back and hip pain that became progressively worse, her doctor did not perform tests that would have determined if the cancer had returned and spread to her bones.</p>
<p style="margin-top: 0px; margin-right: 0px; margin-bottom: 15px; margin-left: 0px; line-height: 16px; padding: 0px; border: 0px initial initial;">The doctor ignored her complaints of pain in several yearly checkups and did not make note of them in his progress notes, making it appear that she was pain-free during that time.</p>
<p style="margin-top: 0px; margin-right: 0px; margin-bottom: 15px; margin-left: 0px; line-height: 16px; padding: 0px; border: 0px initial initial;">This verdict does not suggest that doctors must carry out an entire battery of tests every time a patient complains of pain, but instead that a doctor must listen to his or her patient and take into account their medical history in making accurate decisions.</p>

Her physician was not made aware of the blood work, and she was discharged.  However, an infection soon developed and she was back in the hospital six days later.
